TERMS OF USE

A visitor to / user of the services provided on the VIANEX website understands and agrees that all its pages are provided on an “as is” basis, and the website waives any liability relating to limited duration, deletion, poor performance or inability to store electronically any user data and/or any of the contents of hompages/services.

A visitor/user shall be responsible for accessing the site services, and the relevant access may require payment of fees to third parties (e.g. Internet service providers, fees paid for the time spent on-line). A visitor/user shall be the sole person responsible to pay the relevant fees. Moreover, a visitor/user shall be the sole person responsible for his/her personal equipment and the necessary hardware allowing access to the site services.

USER ETHICS

It is mutually agreed upon and understood that all the information, data, texts, graphics, photographs, images, music files, videos and messages, as well as all the contents in general, whether publicly posted or privately transmitted, shall remain under the exclusive responsibility of the natural or legal person from which all these have originated. This means that users shall be held exclusively liable for all and any contents they post, publish, sent, transmit or make available in any other way through the services provided on the website.It is impossible for the website, due to its size, to control all the contents posted by its users/members on the site services and therefore the website shall not warrant the accuracy, integrity, lawfulness or quality of those contents. It shall in no event be held liable for any errors or omissions included in any of the contents or for any loss or damage that may result from using any contents posted, sent transmitted or made available in any other way by the site users/members.

The users/members agree not to use the site services and to assume full and exclusive liability concerning the following:

1. Posting, publishing, sending, transmitting or using any other method for installing any content that is illegal, harmful, threatening, abusive, damaging, slanderous, vulgar, violent, offensive, racist or unacceptable in any other way, any content that offends the personality and breaches the personal data of others or any intellectual property rights secured by anybody, or incites to hatred and/or to any other criminal offense, as may be specified, or any other form of undesirable promotion of content, including any content that includes digital viruses or any other electronic code, files or programs designed to interfere with, destroy or limit the functioning of any computer or telecommunications software or hardware.
2. Causing harm to minors in any way whatsoever.
3. Impersonating any legal or natural person or making false claims about the identity of a user/member or misleading statements regarding the relationship and/or affiliation of the user/member with any other legal or natural person.
4. Falsifying or otherwise changing the identifiers of the users/members with the purpose to mislead as regards the origin of the content transmitted through the site services.
5. Posting, publishing, sending, transferring or using any other method to install content by a person that does not have the right to make the specific content concerned available according to the law or based on a confidential relationship.
6. Interfering with or disrupting the services or servers or networks that are connected to the site services, or breaching the conditions, procedures and rules of use of these networks.
7. Breaching, intentionally or unintentionally, any local, national, European, international legislation and/or any rules that have legislative effect and concern and/or govern any of the site services.
8. Breaching, in any way whatsoever, the privacy and the personal and social rights of other users (such as by collecting and/or storing the personal data of other users/members).

A user site understands and agrees that the website does not conduct ex ante checks on the contents. However, the website and its competent partners reserve the exclusive right (not the obligation) to refuse to post/publish, transmit or delete, any contents made available through the site services. Moreover, the website and its competent partners reserve the right to delete, without warning, any content that breaches these terms of use.

PROTECTION OF MINORS

Any website visitors/users who are minors are not allowed to access any site services that are deemed to be inappropriate for minors, which cannot possibly be controlled by the website. Any section or service that may contain material that is inappropriate/offensive/immoral includes a warning to visitors/users. The website, however, shall not be held liable if any minor users willingly visit any pages with inappropriate/offensive/immoral content, which is impossible to control continuously.

MEMBER ACCOUNT

The website provides its users with member services after they complete the sign up procedure. As soon as a visitor/user completes the sign up procedure specified by the website, he/she shall receive a message from the website to confirm the password and username that the he/she has chosen. A member shall remain exclusively liable for all the actions carried out under his/her password and username, and his/her user account in general. The members agree to notify the website immediately in the event of any unauthorized use of their account and any actual and/or possible breach of security. The members shall also be solely responsible for making careful use of their account and for logging out from their account by using the standard log out procedure at the end of each session. The website shall not held liable for any damage or loss resulting from the members’ inability to comply and abide with this clause.

SIGN UP

A visitor/user wishing to sign up to the site services agrees: (a) to provide true, accurate, valid and complete information concerning the data requested by the website in the relevant request forms for access to its contents/services, and (b) to keep and update diligently his/her sign up information, to ensure that it is always true, accurate, valid, updated and complete. Moreover, a user/member that posts and/or publishes information, data, texts, graphics, photographs, images, music files, videos and messages consents to the posting/and publication of advertisements by the website on the relevant pages/services. The website shall not be held liable for the communication of a user/member with third service providers advertised on the website and for any commercial transaction that may result from their relationship.

DAMAGE/COMPENSATION

A website user understands and agrees that he shall be the sole person liable to pay compensation to the site and its partners for any litigation that may result between the user and third parties due to the content made available by the user for posting, publication of other transmission through the site services.

The visitors to / users of such services shall abide with the rules of good conduct and decency and shall not make unlawful or immoral comments. The Courts of Athens shall have jurisdiction to settle any disputes.
